Terms & Conditions


Making a booking with us is your agreement to these Terms & Conditions.

Please read these Terms and Conditions closely.  They are the basis of your contract with Hebridean Services Limited t/a Outer Hebrinauts (being ‘us’, ‘we’ or the ‘Company’) in respect of our tours (being ‘tours’) and other products provided by us.

Within these conditions, ‘you’ and ‘your’ means the lead person (being ‘the lead’) paying for a tour, product or service and anyone conjoined on that booking. Members (being ‘members’) refers to any person in your tour booking.  By making a booking, the lead specified in the booking will be deemed to have accepted these conditions on behalf of all tour member in their party for whom they have paid or used a coupon or voucher to facilitate their joining a tour.

We consider ‘written’ or ‘in writing’, where the words are used in these Terms and Conditions, include email communications.

We always try to ensure that the information and prices in our brochures and on our website are accurate; however, from time to time, changes and errors happen that are outside of our control or awareness, and we reserve the right to correct prices and other details if that happens. Please ensure you have checked with us to ensure you are being quoted the most up to date and accurate pricing, noting that all of our tours, products and services are subject to availability.

How to Book
Bookings can only be made via our website at outerhebrinauts.co.uk.  Payment must be made in full at the time of booking, we do not offer deposit taking to reserve space.  Your booking is not confirmed until we confirm, in writing to you, that we have received your payment.  At this point you have a binding contract with us and must adhere to these Terms and Conditions.  All bookings are non-refundable unless subject to relief from the Cancellation clauses noted in these Terms and Conditions.

Changes We Make
We reserve the right to alter, or cancel, itineraries or transport if required to do so. Such events may include, but are not limited to:

  1. weather conditions that mean we cannot successfully supply the tour as advertised;
  2. failure of our tour vehicle;
  3. failure of staff to be available as anticipated to safely operate the tour.

We shall notify you about these changes if they have an effect on the tour you booked.  If they do then you can choose to:

  1. take a tour on a different date, or
  2. to cancel and obtain a full refund of all monies paid by you.

Things You Can Change
If you wish to change your booked tour, such as the date or time we ask that you inform us as soon as possible and be in receipt of our written response as evidence that the change request was accepted.  This can only be done by the person who made the payment, where they are travelling on the tour or the person named as the lead on the booking form at the point of payment.

If you wish to change the lead, you must do so by contacting us and be in receipt of our written response as evidence that the change request was accepted.  There is no requirement to inform us of any other name changes within your booking provided the numbers on the booking do not increase.  Any decrease in the number of persons on your booking will be treated as a cancellation by that person and be subject to the Cancellation clause in these Terms and Conditions.

We will endeavour to meet your change requests but reserve the right to apply an administration fee pf £10 per change.

Where we cannot accommodate your change request, and you no longer wish to tour with us, this will be treated as a cancellation by that person and be subject to the Cancellation clause in these Terms and Conditions.

We will only cancel our tours due to unavoidable and extraordinary circumstances which are outside of our control or which might jeopardise your safety. If we cancel your tour then we will notify you as soon as possible and we will refund your booking monies.

If you wish to cancel your booking prior to your booked tour date you must do so in writing and be in receipt of our written acknowledgement of your cancellation request.  Our tours are non-refundable.

The failure of the lead, or members of the leads booking, to show for a tour within 10 minutes of its stated departure time on your booking will also be deemed a cancellation and will be non-refundable.

The departure of the lead, or members of the leads booking during a tour, for any reason will also be deemed a cancellation and will be non-refundable.

We Can Choose to Refuse Your Tour
We reserves the right to refuse to carry any person on our tours whose conduct or manner is likely to offend other passengers.

We also reserves the right to refuse travel to any person on our tours who is deemed medically unfit or a risk to other tour members as deemed by the Tour Guide at the time of the tour.

Our refusal to allow you to tour is also will be treated as a cancellation by that person and be subject to the Cancellation clause in these Terms and Conditions.  We shall have no further liability to that passenger or to any member of their tour booking.

Health and Safety
Our tours involve the use of a vehicle, the supply and use of optical equipment, the use of electrical and laser based products, the supply of hot and cold liquids, the supply of biscuits and chocolate products.  We will provide an appropriate safety briefing on these actions, identifying where first aid can be sought and an emergency procedure should something unexpected occur that puts anyone at risk.  We require each tour member to acknowledge the risks involved and be aware of reasonable safety when handling our equipment and supplies, edible or otherwise.

We shall not be liable for unforeseeable or indirect losses in this, or any other reagard. We will not be responsible for, nor will we be liable to pay compensation for, any loss, cost, damage or claim to the extent that it results from:-

  1. any act and/or omission by you;
  2. the act or omission of any third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable;
  3. unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been taken; or
  4. any event which either we or our suppliers could not, even with all due care, have foreseen or forestalled.

We regret that we do not carry children under the age of 10 on our tours. Passengers aged 10-18 years old need to be accompanied by an adult. On our tours all ages pay the same price, as published on our website, for the tour.

Other Key Terms
We operate our tours in a mini-bus and we do no allow the carriage of any luggage, other than small back packs or handbags.

We do not carry animals other than Guide Dogs but we must be notified before hand so that we can ensure we have space.

We do not permit smoking, vaping or e-cigarettes in the vehicle. We prefer tour members do not smoke whilst on the tour outside of the vehicle as there can be a general fire risk to our moorlands.  If smoking must be undertaken it must be done so away from our tour group and we request that all butts are disposed of safely.

We welcome feedback.  In the event that you have any complaint during the course of your tour then please bring this to the attention of your driver or tour guide as soon as possible, and we will endeavour to resolve the matter to your satisfaction.  If your complaint is not resolved locally and you wish to complain further then please contact us in writing at 7 Brue, Isle of Lewis, HS2 0QW or using oh@hebrideanservices.com providing all relevant information necessary to enable us to consider your complaint. We would request that any complaints be raised with us within 28 days of the end of your tour, as otherwise our ability to investigate the complaint properly may be affected.

We strongly recommend that tour members arrange suitable insurance to cover cancellations, medical emergencies and any other risks that should be reasonably managed that may result in a loss.  Failure to purchase your own insurance can leave you with unexpected costs.

Force Majeure
Unless expressly stated otherwise in these terms and conditions, we will not have any liability to you if we are prevented from fulfilling our contractual obligations to you as a result of any event which is outside our control.

Such events may include (but are not limited to)@

  1. war or threat of war;
  2. terrorist activity or the threat of terrorist activity;
  3. civil commotion or riot;
  4. any action taken by a governmental or public authority;
  5. industrial disputes;
  6. collapse of buildings,
  7. fire, explosion or accident;
  8. traffic or road conditions or road closures;
  9. technical or mechanical breakdown;
  10. adverse weather conditions;
  11. natural disasters, pandemics, outbreak of disease or illness locally; and
  12. all similar events or circumstances.

Enforceability of Terms
If any provision of these terms and conditions is found to be illegal or unenforceable, that shall not affect the validity and enforceability of the remainder of these terms and conditions.

Governing Law and Jurisdiction
To the extent permitted by law, these terms and conditions shall be governed by and construed in accordance with Scots law and any matter or claim arising from them shall be dealt with only by the Scottish courts.
